Competition rules

This material is the only document that sets out in a binding, complete and clear manner the terms and conditions of the marketing competition entitled “Show What You Can Do and Win a surprise package” (the “Competition”).

1 Definition of terms

1.1 Promoter, Organiser
The promoter and organiser of the Competition is Profinit EU, s.r.o., with registered office Tychonova 270/2, Hradčany, 160 00 Praha 6, IČ: 04434081 (hereinafter referred to as the “Promoter”).

1.2 Competition Period
The Competition takes place on November 20 (hereinafter the “Competition Period”).
The Competition Quiz and Form will be published on the Promoter’s website (https://jsmeprofinit.eu/en/kviz/) at the Competition Period with a link to these full rules.

1.3 Participants
The Competition is open to any natural person of any age with a permanent residence and address in the Czech Republic (hereinafter referred to as “Competitor” or “Participant”).

1.4 Only the Entrant who duly fulfills all the terms and conditions of this competition and meets the criteria for the winner (“Winner”) may be the winner of the competition.

2 Competition Terms and Conditions

2.1 Only those entrants who complete all 3 questions of the quiz and fill in the form, always with truthful information, will be entered into the prize draw.

2.2 Participants who answer all quiz questions correctly will be entered into a draw for three prizes. Three winners will receive a prize marked “Prize” as described in clause 3.1.

2.3 Each competitor may answer the quiz only once. He/she can also win the competition only once.

2.4 The Promoter is entitled to exclude the Participant from the Competition.

3 Prizes and their delivery

3.1 The competition includes three prizes – a surprise package.

3.2 The winners will be notified of the prize by e-mail no later than the day after the end of the competition.

3.3 The organizer will agree with the winner on the place of the prize presentation.

3.4 In the event that the Promoter fails to contact the Winner or the Winner fails to accept the prize offered, the Winner will forfeit their full entitlement to receive the prize and the prize will be offered to the next Winner in line.

4 Final provisions

4.1 The organizer is not responsible for any technical error in the organization of the competition and has the right to make the final decision in all matters of the competition, including its termination. Any claims or objections shall be finally decided by the organizer. The Promoter reserves the right to shorten, suspend or cancel the Competition without compensation or to unilaterally amend or supplement the Competition by announcing the change on the Competition website where the full and valid Terms and Conditions are available.

4.2 All employees of the organizer, the organizer of the competition and all cooperating persons and persons close to them are excluded from the competition in accordance with the provisions of § 116 of the Civil Code. In the event that the winner is such a person, the prize will not be returned. Similarly, the prize will not be handed over if the Promoter discovers or has reasonable suspicion of fraudulent or dishonest behaviour on the part of any of the participants or any other person who helped the participant to win the prize.

4.3 The Organiser, as a data controller within the meaning of the General Data Protection Regulation (hereinafter referred to as “GDPR”), will process the Entrants’ personal data for the purpose of fulfilling the relationship with the Entrant that arises from the Entrant’s participation in the Competition (Article 6(1)(b) GDPR).

Participation in the competition and the provision of personal data is voluntary.

The Promoter will process the personal data of the Participants to the extent necessary for the fulfilment of the Competition.

In the case of winners, the Promoter will retain personal data for a maximum of 3 years from the end of the Competition in order to protect the Promoter’s legitimate interests.

The organiser will process the personal data itself or delegate the processing to a processor in accordance with Article 28 GDPR.

As data subjects within the meaning of the GDPR, entrants and winners are entitled to the following rights related to the processing of their personal data:

  • the right to free information about what personal data the Organiser processes (Article 15 GDPR);
  • the right to rectification of incorrect personal data processed (Article 16 GDPR);
  • the right to erasure of the personal data processed (Article 17 GDPR);
  • the right to restrict the processing of personal data (Article 18 GDPR); and
  • the right to data portability (Article 20 GDPR).

Participants may exercise these rights with the Promoter at the address above or at the e-mail address gdpr@profinit.eu. With any complaints about the processing of personal data, Participants may contact the supervisory authority, which is the Office for Personal Data Protection ( www.uoou.cz).

4.4 There is no legal right to the release of prizes in the competition and no legal action can be taken to claim the prize. Prizes cannot be redeemed in cash or exchanged for other consideration.

4.5 The Promoter is not responsible for any defects in any prizes awarded in the competition.

4.6 These Terms and Conditions are valid and effective from 20 November 2023.
